Shipping Terms & Conditions

These Shipping Terms & Conditions govern all services provided by Cargomax International Inc. (“Cargomax”, “we”, “us”) as an international freight forwarder. By requesting a quotation or instructing us to arrange a shipment, you (the “Customer”) accept these conditions.
1. Standard Trading Conditions
Cargomax is a member of the Canadian International Freight Forwarders Association (CIFFA). All business is undertaken subject to the current edition of the CIFFA Standard Trading Conditions, which are incorporated into these terms by reference and which limit our liability. A copy is available on request. Where these terms and the CIFFA Standard Trading Conditions conflict, the CIFFA Standard Trading Conditions prevail in respect of our liability as a forwarder.
2. Our role
Except where we expressly agree in writing to act as a carrier, Cargomax acts as the Customer’s agent in arranging transportation, customs clearance and related services with third-party carriers and service providers. We select carriers and routes with reasonable care but are not the carrier of the goods unless stated otherwise.
3. Quotations and rates
Quotations are based on the information provided by the Customer and on rates, surcharges and exchange rates in effect at the time. They are valid for the period stated and may be revised if that information is inaccurate or incomplete, or if circumstances beyond our control (including carrier rate changes, fuel surcharges, currency fluctuations or port charges) affect the cost. Quotations exclude duties, taxes and inspection or demurrage charges unless expressly stated.
4. Customer’s responsibilities
The Customer warrants that it is authorized to ship the goods and that all information and documents provided (including description, weight, dimensions, value and customs data) are complete and accurate. The Customer is responsible for proper packing, marking and labelling, for ensuring the goods are not prohibited or restricted, and for compliance with all applicable export, import and customs laws. The Customer shall indemnify Cargomax against any claim, penalty or expense arising from inaccurate information or non-compliance.
5. Dangerous and special goods
Dangerous, hazardous, temperature-sensitive, out-of-gauge or high-value goods must be declared in writing before shipment and are accepted only with our prior agreement and subject to any special conditions and applicable regulations.
6. Cargo insurance
Goods are not insured by Cargomax unless the Customer requests cargo insurance in writing and we confirm coverage. In the absence of such insurance, the goods travel at the Customer’s risk, subject only to the limited liability of the carriers and of Cargomax under the CIFFA Standard Trading Conditions. We strongly recommend that Customers arrange all-risk cargo insurance.
7. Charges and payment
Invoices are payable in accordance with the terms stated on the invoice or quotation. Late payments may bear interest at the rate permitted by law. We may exercise a lien over goods and documents in our possession for any amounts owed to us.
8. Limitation of liability
Our liability is limited in accordance with the CIFFA Standard Trading Conditions and any applicable international convention (such as the Hague-Visby Rules, the Montreal Convention or the CMR, depending on the mode of transport). To the fullest extent permitted by law, Cargomax is not liable for indirect or consequential loss, or for loss or delay caused by events beyond our reasonable control.
9. Claims
Any claim must be notified to us in writing without delay and in any event within the time limits set out in the CIFFA Standard Trading Conditions and the applicable transport convention. Failure to give timely notice may bar the claim.
10. Force majeure
Cargomax is not responsible for failure or delay in performance caused by circumstances beyond our reasonable control, including weather, port congestion, carrier delays, strikes, war, sanctions, government action or acts of God.
11. Governing law and jurisdiction
These conditions are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. The courts of the judicial district of Longueuil, Province of Quebec, Canada shall have exclusive jurisdiction over any dispute, without prejudice to any mandatory rule of an applicable international transport convention.
