DOCUMENTATION REQUIREMENT FOR SHIPPING OIL AND GAS EQUIPMENT TO PERU

DOCUMENTATION REQUIREMENTS FOR OIL AND GAS EQUIPMENT

Key Documentation for Importing Oil & Gas Equipment into Peru

Commercial Invoice

A detailed invoice outlining the transaction, including buyer/seller information, a full description of the oil and gas equipment, quantities, and declared value in the relevant currency (typically USD or PEN). Required for customs valuation and tax calculation.

Bill of Lading (BOL)

A legal transport document between the shipper and carrier specifying the type, quantity, and final destination of the oilfield equipment. Mandatory for port entry and customs clearance through Peru’s Customs Authority (SUNAT – Superintendencia Nacional de Aduanas y de Administración Tributaria).

Packing List

An itemized list of all cargo, including technical descriptions, packaging type, dimensions, and gross/net weights — essential for verifying cargo against the invoice and for inspection purposes by Peruvian customs authorities.

Certificate of Origin

Certifies the country of manufacture. Required to access preferential tariff benefits under trade agreements such as MERCOSUR, the Pacific Alliance, or Peru’s bilateral trade agreements.

Import License (if applicable)

Certain oil and gas equipment — such as high-capacity generators, pressurized containers, or emissions-related machinery — may require prior import authorization from the Ministry of Production (PRODUCE) or other sectoral regulators.

Customs Declaration (Declaración Aduanera de Mercancías – DAM)

A formal declaration to SUNAT including details about classification, origin, value, and applicable duties and taxes. The process is managed through Peru’s electronic customs system (VUCE).

Technical Documentation

Includes manuals, engineering diagrams, certifications, and data sheets — critical for verifying compliance with Peruvian technical and safety regulations, especially for energy or industrial use equipment.

Insurance Certificate

Proof of international cargo insurance (land, sea, or air). Highly recommended for valuable, sensitive, or specialized oilfield equipment in transit to Peru.

Harmonized System (HS) Codes

Accurate HS codes are essential for proper classification, tariff calculation, and compliance with Peruvian customs. Codes must align with SUNAT’s tariff schedule and may be verified using the Arancel de Aduanas del Perú.

Pro-forma Invoice

A preliminary invoice used for budgeting, import permits, or initiating procurement before issuing the final commercial invoice. Useful for estimating taxes or arranging financing.

Environmental and Safety Certifications

Mandatory for equipment that may affect air, water, or soil quality. Equipment could be reviewed by MINAM (Ministerio del Ambiente) or require documentation under OEFA and DIGESA standards for environmental compliance.

Letter of Credit or Payment Terms Agreement

Defines financial terms between buyer and seller. Often required for high-value shipments, financial institutions, or exchange control processes.

Import Duties and Taxes Payment

Proof of payment for applicable customs duties, 18% VAT (IGV), and any sector-specific levies. Rates depend on HS classification and eligibility for tariff preferences.

Compliance and Regulatory Requirements for Oil & Gas Equipment Imports into Peru

Registration with SUNAT (Peruvian Customs Authority)

Importers must be registered with SUNAT and possess an active RUC (Registro Único de Contribuyentes). Only authorized importers or customs brokers may submit declarations.

Compliance with Peruvian Technical Standards

Imported equipment must comply with local standards issued by INACAL (Instituto Nacional de Calidad) and may require conformity certifications for safety, electrical, or environmental compliance.

Coordination with Energy & Environmental Authorities

Depending on the equipment type and application, coordination may be required with:

  • MINEM (Ministerio de Energía y Minas) – for exploration, extraction, and generation equipment

  • MINAM (Ministerio del Ambiente) – for equipment with environmental impact

  • OEFA (Organismo de Evaluación y Fiscalización Ambiental) – for environmental compliance monitoring

  • DIGESA – for public health-related technical regulations

Engage with a Licensed Customs Broker (Agente de Aduanas)

Due to Peru’s regulatory framework, it’s highly recommended to work with a licensed Agente de Aduanas specialized in oil & gas or industrial equipment to manage SUNAT filings, document control, and compliance with national regulations.
